Overview


Contrary to what many people believe, The Current regulations in the United States severely limit practical UAS Commercial Operations without special approvals. However, It is possible for Practical Commercial Operations to be conducted under specific waver approvals. Over 3000 waver requests for Commercial Operations in the US have been approved by the FAA and many more are under consideration. The Waver process can be long and involved by those unfamiliar with the FAA's processes. According to the FAA a "properly" prepared application can be approved in as little as 120 days.

The FAA has several areas that they consider when evaluating an applications for waver. The FAA has the ability to grant the following Waivers:


  • Fly a UAS from a moving aircraft or a vehicle in populated areas
  • Fly a UAS at night
  • Fly a UAS beyond your ability to clearly determine its orientation with unaided vision
  • User a visual observer without following all visual observer requirements
  • Fly multiple UAS with only 1 remote pilot 
  • Fly a UAS without having to give way to other aircraft 
  • Fly a UAS over a person/people
  • Fly a UAS:Over 100 miles per hour groundspeed, Over 400 feet above ground level (AGL), With less than 3 statute miles of visibility or ​Within 500 feet vertically or 2000 feet horizontally from clouds


The FAA also recently issued the first Part 135 Drone certificate to a UPS Subsidiary. The application process is similar to the application process for a manned aircraft. The SAS mortal is the gateway to certification. GPA Services is the industry leader in SAS Portal submissions.
